Personal data processing
Respecting the privacy of individuals is an important concern for THEMA Consulting SA (hereinafter THEMA).
We undertake to comply with the provisions of the new Federal Data Protection Act. Swiss data (nFADP / nLPD) of September 25, 2020 as well as those of European Union Regulation 679/2016 of April 27, 2016 relating to data protection (GDPR or General Data Protection Regulation).
What is described in this document is intended to exclusively manage the processing of data collected directly by the following website: themaconsulting.ch.
It also applies to data that THEMA is required to collect on social networks.
The processing of personal data on behalf of legal entity customers is the subject of agreements directly concluded with them and is not covered by this policy.

Who is the DPO?
THEMA has NOT appointed a Data Protection Officer (DPO). For any issue or question, please contact THEMA at the addresses detailed on this page.
What is personal data?
Personal data means any information relating to an identified or identifiable natural person.
Sensitive personal data means:
- data relating to religious, philosophical, political or trade union-related views or activities;
- data relating to health, the private sphere or affiliation to a race or ethnicity;
- genetic data;
- biometric data that uniquely identifies a natural person;
- data relating to administrative and criminal proceedings or sanctions;
- data relating to social assistance measures;
Processing means any handling of personal data, irrespective of the means and procedures used, in particular: the collection, storage, keeping, use, modification, disclosure, archiving, deletion or destruction of data.
Data subject means a natural person whose personal data is processed.
Processor means a private person or federal body that processes personal data on behalf of the controller.
What are the purposes of the processing and/or use of your personal data? How long do we keep the data?
We collect data for the following purposes:

Carry out targeted commercial prospecting operations, including the sending of marketing and information materials and/or newsletters by e-mail and invitations to events or courses provided by THEMA.

Who are the recipients of your personal data?
THEMA collects data which is intended for its marketing and customer relationship management services and will only be used for this purpose.
We share your personal data only with the following third parties:
- Supporting for the management of the information system and communication network (including e-mail);
- Host of our site;
- General supporting activities or consultancy;
- Public authorities (only if we are obliged to do so under our legal obligations or at the request of judicial authorities);
- Marketing providers to develop and manage our social networks, our forms of contact or carry out our advertising campaigns (sending e-mailing for example, etc.).

Do we transfer data abroad (outside Switzerland or the European Union)?
We carry out our processing within Switzerland or exceptionally within the European Union and do not transmit our data to recipients located outside Switzerland or outside the European Union except when explicitly and previously consented by the subject or for legal obligation.
Is Personal Data Collection mandatory, necessary or optional?
We may collect personal data from you, or receive it from you, via our websites, forms or pages dedicated to THEMA on social networks. This data can be: your surname, first name and email.
You communicate this personal data directly to THEMA, for example when you make a contact request via the form on the website. In other cases, we collect data through the use of cookies to understand how you use our websites or our social networks.
When we collect data through a form to be completed, we identify mandatory fields with the label “(required)”, those fields are essential to process your request. This is usually the name, surname and email. Therefore, not saving the fields marked in such a way will make it impossible for us to answer you.
Please DO NOT send us any sensitive personal data.
What are your rights? (Data subject rights)
Any individual subject to the processing of personal data has the right to exercise their rights of access, rectification, deletion, opposition, limitation to the processing of their data, in accordance with nFADP and GDPR. The individual can also exercise a right to the portability of his personal data.
These rights can be exercised directly with THEMA.
You also have the right to appeal to your supervisory authority (for Switzerland: FDPIC).
To request the deletion by our communication list please write an email to privacy@themaconsulting.ch specifying as a subject “Unsubscribe me from Marketing Communication” or directly through the newsletter received.
Validity and updates
THEMA can modify, update, add or remove parts of this document at any time. Before using our website or related resources (e-mail, phone number, social accounts), users/subjects must consider only effective notices and policies, for this reason this document always displays the release date.
